02 Subject Matter of a Litigation Response Plan

There are two parts of a Litigation Response Plan: the legal part of the plan and the technical part. The legal part includes information about the litigation history at your company, the electronic discovery strategies you will use in your cases, and other legal issues. Corporate counsel and outside counsel may help prepare this part of the plan.


The technical part of the Litigation Response Plan includes information about your IT and computer systems, the data universe, and the files and devices that contain data that may be involved in your litigation. For this part of the plan, it is essential to use someone with an IT background, and if he or she also has legal training it would be a great benefit.


What does the plan look like?  It is a large document with many exhibits. Often, it's printed and assembled in a notebook and kept in the corporate legal department. There are many examples of attachments that are included with a Litigation Response Plan. A few examples include:  corporate organizational chart, human resources information, computer and IT documentation, litigation history, and many reports and spreadsheets.
